Dustie Waring has officially confirmed his split from Between The Buried And Me, following a long and legally entangled departure from the progressive metal band.
Waring, who had been a longtime guitarist for the group, was fired in 2024 after facing a disputed rape allegation, which he publicly denied. The band later claimed the termination stemmed from what they described as a “failure to render first-class live performances,” a “failure to timely notify the band of his inability to perform at all the band’s live performances,” and “his overall demeanor and negative behavior with his fellow band mates, their family members, and the band’s crew.”
While Waring had briefly returned to the fold in 2023, things had soured again by spring 2024, with both sides involving legal representation.
In a July 23rd statement, Waring addressed the situation directly:
“Time for an update.
I’ve been off the road for a while now, which hasn’t been easy, since music has been my life for as long as I can remember. While I haven’t spoken publicly about my absence until now, I feel it’s time to address the questions about my involvement with the band.
After 20 years of albums, tours, and great memories, BTBAM and I have officially parted ways. The delay in saying something wasn’t about avoidance, time and privacy were necessary, and I truly appreciate your patience and understanding.
I want to thank the guys in BTBAM, all of the fans, our crew, and the many companies and collaborators who made the last two decades an experience beyond anything I could’ve imagined as a kid. Growing up with all of you, onstage and off, has been one of the greatest gifts of my life.
Thank you to everyone who’s checked in or sent kind words during this time, your support has meant the world and made a real difference. I’ve been quietly working on lots of new music and I’m excited to share more with you soon. Looking forward to seeing you all soon.

Jack Morley read the lamb goat article. It says there were issues with dusty and the band, bands family, and crew. Don’t know how much is true. Dusty is the most replaceable member of the band. It will be good to hear him playing some stuff that you can tell he wrote.
Jack Morley a few years back it came out that Dusty had essentially date raped a woman, gotten her pregnant (subsequent abortion after) and then gaslit her about it afterwards in text messages the person posted screen shots of. I’m not sure how much of it was true, but it was damning enough for the band to immediately separate themselves from him. It caused a bunch of internal drama they didn’t publicize (he ended up filing a lawsuit against them for withholding royalty payments), it was messy, but he seemed like he was in the wrong with the way he went about things.

Seems like he’s a bit of a dick, to put it lightly. There’s a woman in a thread on this post who said Dusty said and did some really messed up stuff to her. Joel Hofma it came out that that entire thing was actually a dude fabricating the whole story and he was innocent. What most people in the comments aren’t mentioning which I’m mostly assuming is because they didn’t see or hear about it, was right before a show on a tour he was not on after being cleared, he put up on his IG story court documents that indicated there was legal beef between him, Tommy, and Paul specifically. Essentially it stated that Tommy and Paul wanted him out of the band because he couldn’t perform without a chair. However he had surgery at that point to fix his back issues and there weren’t really fans who really cared he was in a chair for some parts of the shows prior. It then went on to say that there was around a six figure sum to be made by Paul and Tommy by removing Dustie from the band and something about Tommy’s wife making statements surrounding the allegations, despite them turning out not to be true. A lot of the fans were left in limbo unsure of what was going on up until that point and BTBAM never officially announced anything before or after and these few glimpses from Dustie were the only thing presented. I followed this band since highschool and always thought they’d be a safe band so I followed this pretty closely as it was all pretty disappointing. Nobody obviously will probably ever know for sure what actually went down, but Blake is still very much involved with Dustie and I find it hard to believe he would be or kicking back up glass casket if there wasn’t some validity with Dusties claims if not at base confirming the catalyst for all this was bs. It seems he’s still cool with the rest of the band still as well so who knows. It’s an all around bummer after 20 years of music with them.

Joshua Saddlemire You should probably review the stuff that’s out there. He did send those messages, and his lawyer claimed they were cherry picked to make him look bad. The lawyer then said they’d be forced to release the full transcripts if the accuser didn’t back down. The accuser didn’t take down their original post, nor did they recant their statement anywhere publicly, so I don’t know if that was satisfactory enough for Dustie and his team to not release the full transcript.
The communique between Dustie’s lawyer and the band’s lawyer also claims the allegations were proven false, but a lawyer saying something in a letter doesn’t mean it’s true. It’s not like the message was a legally binding document or even presented in any official court setting. It’s all hearsay, and the only people that know the full truth are Dustie and the accuser.
Whatever happened between him and the rest of the guys, we may never know. But the rest of the band may very well know some stuff that us fans don’t. There were more accusations after they brought him back for a festival appearance and the mods of their Discord apparently stepped down when the band allowed him to play.
I love the band and always liked Dustie, and I still do even if there are some reservations with the murkiness of his conduct. It makes me sad they couldn’t work something out to keep that lineup together, but at the end of the day this is between him and the band, and we as fans just cannot say for certain what went down.

I’ll tell you now having seen them #41 times since 2009 that the vibe is off. Has been since the beginningof all this.
