Foo Fighters drummer Ilan Rubin has been named in a newly filed cross-complaint as an ongoing legal dispute surrounding Q Drum Co. continues to unfold in California.
According to RadarOnline, the lawsuit stems from a business conflict involving the boutique drum manufacturer that Rubin co-founded alongside Jeremy Berman, who passed away from stage four stomach cancer in January 2023. The legal battle has been ongoing since December 2024.
Following Berman’s death, ownership of his 51 percent stake in the company was transferred to his partner, Brandi Booth, who was named the executor and sole beneficiary of his estate. The disagreement over control of the company eventually led Rubin and several business associates to file suit against Booth, alleging fraud, conversion, unfair competition, and other claims.
The latest development comes in the form of Booth’s cross-complaint, which accuses Rubin and his associates of breach of fiduciary duty, breach of contract, fraud, unjust enrichment, and civil conspiracy.
According to the filing, Booth alleges Rubin refused to recognize her authority within the company, improperly took control of business assets, manipulated financial records, sold company property without providing an accounting, secured Q Drum trademark registrations without her knowledge, and altered tax filings. The complaint also claims Rubin and business associate Roger Ko assumed control of funds raised through a GoFundMe campaign established following Berman’s illness.
Rubin’s original lawsuit alleges Booth improperly dissolved the original company before creating a new business using the Q Drum Co. name. Among the relief sought, Rubin has requested the reinstatement of the original company.
The competing claims remain pending before the San Bernardino County Superior Court. Rubin previously addressed the situation in a since-deleted statement issued in July 2023, stating he had the support of Berman’s parents while working to stabilize the company’s operations following his co-founder’s death.
