Veteran Christian metal outfit Demon Hunter have filed a lawsuit against Netflix, Netflix Studios, and AEG Presents, alleging trademark infringement, false designation of origin, and unfair competition tied to the hit animated series ‘KPop Demon Hunters.’
The lawsuit, filed Tuesday, August 18, in a California court through the band’s operating corporation Hyde Lane, centers on what Demon Hunter claim is growing consumer confusion between their established brand and the Netflix property.
According to a complaint obtained by Complex, the band are taking issue with trademark applications and merchandise-related activity surrounding ‘KPop Demon Hunters’ as the franchise expands into live events and other areas that overlap with the band’s existing market.
The lawsuit reportedly points to a particularly notable example of that alleged confusion. One fan of the animated series apparently purchased approximately $500 worth of tickets to a Demon Hunter concert in Albany, NY, believing the tickets were for a ‘KPop Demon Hunters’ event. The individual had reportedly intended to attend the show with their five- and six-year-old daughters before realizing the mistake and seeking a refund.
Demon Hunter, who formed in 2000, have spent more than two decades building their presence in the Christian metal scene. The band have released 12 studio albums and toured extensively throughout their career.
The group are seeking a jury trial and argue that continued use of similar branding and activity in overlapping areas could create further confusion among consumers while also leading to inappropriate associations between the band and the animated franchise.
As part of the lawsuit, Demon Hunter are seeking to have what they describe as their “rightful interests” in the trademark restored. They are also asking that Netflix be prohibited from using the ‘KPop Demon Hunters’ name, in addition to seeking restitution and treble damages.
