Mötley Crüe have secured a decisive legal victory in their long-running dispute with former guitarist Mick Mars, with an arbitrator ruling entirely in the band’s favor and rejecting all claims brought by the guitarist in his 2023 lawsuit.
Mars originally filed suit after announcing his intention to step back from long-term touring due to complications stemming from ankylosing spondylitis, a progressive inflammatory condition affecting his spine. While Mars maintained that he was not quitting the band outright and wished to remain involved in studio work and limited live appearances, Mötley Crüe argued that stepping away from touring triggered provisions in a governing agreement signed in 2008.
According to the band, that agreement stipulated that any member who ceased touring forfeited their 25% share of touring revenue. In response, the group offered Mars a severance-style deal that would have granted him 7.5% of their 2023 tour earnings, despite not participating in the run, in exchange for relinquishing his future touring stake. Mars rejected the offer, prompting arbitration and a highly public exchange of allegations between both parties.
During the dispute, Mars accused his former bandmates of performing to backing tracks during recent reunion tours, alleging lip syncing and miming onstage. The band countered by claiming Mars’ live playing had deteriorated significantly, requiring sound engineers to compensate for his performance in real time.
Those accusations ultimately collapsed under arbitration. Evidence presented by audio experts contradicted Mars’ claims, leading him to formally recant his allegations under oath. The arbitrator, retired judge Patrick Walsh, ruled that Mars had forfeited his entitlement to touring revenue by stepping away from live performances and upheld the band’s decision to terminate him as an officer and director for legal cause.
As part of the ruling, Mars was ordered to repay $750,030 in unrecouped tour advances and sell his ownership stake in the band to the remaining members for $505,737, resulting in a net judgment of $244,293 in favor of Mötley Crüe.
The band’s legal counsel, Sasha Frid of Miller Barondess, LLP, described the ruling as a full vindication.
“This dispute was about protecting the integrity and legacy of one of the most successful bands in rock history. With the arbitrator rejecting every claim and enforcing the parties’ agreements as written, the band has been fully vindicated—legally, financially, and factually.”
Mötley Crüe have since filed a petition in Los Angeles County Superior Court to formally confirm the arbitration award.
Mars’ attorney, Ed McPherson, sharply criticized the outcome in comments to Rolling Stone, calling the ruling fundamentally unjust and signaling that a potential challenge is being considered.
“The decision is awful. It’s not fair. This band has never been fair to Mick. When Mick said I can’t tour anymore because of a hideous disease, but I can still write, perform one-offs or residencies, and record, they said, ‘Sorry Mick. It’s been 43 years, but you’re out.’ This arbitrator said it’s fine.”
McPherson added that Mars is weighing whether further legal action is worth pursuing, noting that the guitarist may ultimately choose to move on entirely.
“Basically, he’s over Mötley Crüe.”
As it stands, the arbitration ruling represents a comprehensive win for the band, bringing one of the most contentious legal disputes in recent rock history to a close—at least for now.

And he just admitted in court that he lied and you could bet your ass that’s a good reason why he lost his lawsuit..

Saw them live a couple years ago. John 5 and Tommy were good. Vince can’t sing anymore and Nikky well… Hasbeens is the first word that comes in my mind. I used to love them, I was a huge fan. But when the time has come to quit but you don’t, your legacy goes down the drain. Sad…
