Lawyer Weighs Class-Action Lawsuit Over ‘Tool Live In The Sand’ Setlist Dispute

Augusta, GA-based lawyer Stas Rusek is exploring potential legal action against Tool and the promoters behind ‘Tool Live In The Sand’, the band’s first-ever headlining destination festival. On March 10th, Rusek began gathering complaints from dissatisfied attendees, considering a class-action lawsuit over the band’s alleged failure to deliver on their promise of ‘two unique sets’. His call for participants was posted on Facebook and has since gained traction among frustrated fans.

The backlash surrounding the event has been widespread. Fans traveled to Punta Cana, Dominican Republic, expecting two distinct performances from the multi-platinum progressive metal act. However, while the setlists technically differed each night, Tool repeated four of the same songs—“Fear Inoculum,” “Rosetta Stoned,” “Pneuma,” and “Jambi”—leaving many feeling shortchanged.

Considering the high premium fans paid for the event—including travel expenses and ticket costs that far exceeded a standard Tool show—many felt misled. The controversy has only amplified ongoing criticism of the band’s history of premium pricing, from costly VIP packages to expensive merchandise.
