Netflix has now responded to the trademark infringement lawsuit filed by Christian metal band Demon Hunter over the streaming platform’s hit animated franchise, ‘KPop Demon Hunters.’
As previously reported, Demon Hunter filed suit against Netflix, its studio division, and AEG Presents, alleging trademark infringement, false designation of origin, and unfair competition surrounding the use of the Demon Hunter name in connection with the franchise.
The band argues that the continued expansion of ‘KPop Demon Hunters’ into areas that overlap with its own established business has created confusion between the animated property and the band’s Demon Hunter brand.
According to the lawsuit, the confusion has allegedly extended to live events, with the band claiming that some concertgoers have purchased tickets to Demon Hunter shows believing they were attending events associated with ‘KPop Demon Hunters.’ The group also claims that the franchise has affected its online visibility by influencing search results and generating accidental social media mentions.
Demon Hunter, who formed in 2000, are seeking a jury trial and are asking the court to restore what they describe as their “rightful interests” in the Demon Hunter trademark. The band is also seeking to prevent Netflix from using the ‘KPop Demon Hunters’ name, along with restitution and treble damages.
Netflix has now publicly addressed the lawsuit, dismissing the allegations and stating that it intends to defend itself in court.
“These allegations are without merit. Netflix has created an Academy Award winning global phenomenon with KPop Demon Hunters that has inspired fans around the world with its powerful music, storytelling, and characters. We look forward to vigorously defending this matter.”
The legal dispute now moves forward as both sides stake their claims over the use of the Demon Hunter name.
